PLEASE NOTE that several events could lead to a different outcome than expected, namely: a) exercise of the right of redemption; b) exercise of the right of pre-emption; c) insolvency of the debtor; d) payment of the debt; e) possible verification of irregularities that invalidate the sale. Accept the offer. As the property for sale is in the possession of the custodian/debtor, they will be notified to hand it over voluntarily. If they fail to do so, the proposer will have to request the forced delivery of the property, a procedure that will incur costs that will be the responsibility of the proposer, in accordance with civil procedural law (see Article 50, No. 4 of Decree No. 282/2013 of August 29). PLEASE NOTE: - this transfer is exempt from the requirement to present a license for use or occupation, and the buyer is advised of the burden of legalizing the property, should this be necessary (Article 833, No. 6 of the Code of Civil Procedure). It is the sole and exclusive responsibility of the proposer to verify the condition of the asset to be acquired, and therefore, before submitting a proposal, they must ensure that it meets their expectations and is in the desired condition. They should also bear in mind that, given the specific nature of a judicial sale and the fact that the asset is not delivered at the time of payment, it may suffer deterioration or alterations. If the asset is subject to registration, there is also the payment of fees due to the entity responsible for the registration.
