Notes

TERMS OF SALE: 1. In insolvency proceedings, the assets are sold in their current physical and legal condition and are transferred free of liens or encumbrances; 2. Interested parties are responsible for visiting and inspecting the assets – by appointment – particularly regarding the areas, in accordance with official documents, with the purchaser assuming responsibility for purchasing what they have visited and committed to acquiring, regardless of whether they have carried out the visit or inspection of the asset; 3. Visits will not be scheduled in the last five working days preceding the closing date of the auction, unless expressly indicated otherwise by the Judicial Administrator. Requests for scheduling a visit must be made in advance, by sending a request to the email address jose.a.cecilio@aj.caaj.pt, and may be submitted from the beginning of the auction up to six working days before its closing date; 4. Sales in insolvency proceedings are exempt, under the law, from the requirement to present the Occupancy Permit, Energy Performance Certificate, and other municipal documentation (as per Article 833, paragraph 6 of the Code of Civil Procedure and Article 164, paragraph 6 of the Insolvency and Corporate Recovery Code). Therefore, under the same legal provisions, the legalization of the properties, if applicable, is the responsibility of the buyer; 5. By submitting a proposal, it is presumed that interested parties have inspected the property and are aware of its characteristics. Any responsibility for its state of conservation, as well as any incorrect description of information or photographic record that may be misleading, is disclaimed. Interested parties should also inquire with the competent authorities about other characteristics, licenses, and/or other aspects they deem relevant. Failure to verify these details is not grounds for annulment of the sale; 6. No assets will be awarded to bids below the minimum sale price. 7. Upon being awarded the contract, the successful bidder shall pay, by bank transfer or certified check, 20% of the sale price as a deposit and initial payment, payable to the Insolvency Estate; 8. Once the 20% payment is secured, the corresponding deed/preliminary purchase and sale agreement will be scheduled, to be executed within a maximum of 60 working days after the award, at a location, date and time to be designated by the Insolvency Administrator, with the successful bidder being notified of the date, time and location for its execution. 9. All costs inherent to the execution of the respective deed/preliminary purchase and sale agreement shall be borne by the purchaser; 10. The deed/preliminary purchase and sale agreement will only be executed with the winning bidder, and the assignment of the contractual position is not permitted; 11. The remaining balance of the sale price will be settled at the time of the execution of the deed/DPA of purchase and sale, by bank check or certified check payable to the Insolvency Estate or alternatively by bank transfer to the account of the insolvency estate 5 days in advance; 12. Movable property is not included in the sale; 13. It is the sole and exclusive responsibility of the bidder to verify the goods subject to sale, ensuring that they meet their expectations and are in the desired condition. Therefore, failure to verify the goods, their operational status, the existence of licenses/permits and/or ignorance of any characteristics are not grounds for the annulment of this sale; 14. In the absence of payments within the stipulated deadlines, it will be considered a withdrawal and consequent notification on the portal “e-leilões.pt”, as well as the measures provided for in Article 825 of the Code of Civil Procedure.

⚠ Important warnings before bidding

  • The property is sold as-is, with no warranties. It may not be licensed and its characteristics may not match the documentary records — bringing it into compliance is the buyer's responsibility.
  • The highest bid does not guarantee the award: payment of the debt, exercise of a right of first refusal by third parties, a challenge to the sale, insolvency/PER proceedings or the death of the debtor may all prevent it.
  • A bid submitted on e-leiloes.pt is irrevocable.
  • Information about the property is the sole responsibility of the enforcement agent. Visit the property and check the documentation before bidding, and seek advice from a solicitor or lawyer.
  • Atlas's discount analysis is merely indicative, based on the parish's median prices; the real value depends on the property's condition.
